You do not have to have started That Old Black Magic to obtain this item. Additionally, there is bad luck mitigation so that you are guaranteed to receive this item after about 60 kills. Once the drumset is assembled, the drumsticks will disappear as they are taken by the Spirit of Rhythm to use.
